New law authorises dawn raids in dual-use and EU sanctions cases

The Danish Parliament has passed a Bill allowing the Danish Business Authority access to conduct dawn raids without a court order in cases involving dual-use and EU sanctions. The new law will enter into force on 1 January 2021.

The law is a significant tightening of Danish administrative enforcement in relation to dual-use and EU sanctions cases. Export businesses and transport operators, in particular, should pay attention to the new rules, which also authorises a penalty against persons and businesses that refuse to assist in the investigations to be conducted by the Authority under the law.
