Directors and Officers liability

Kromann Reumert has unique experience on the Danish market in the field of directors and officers liability cases, both before courts of law and in arbitration.

Questions of directors and officers liability arise mainly in cases where a bankruptcy estate, an enterprise, a business owner and/or a third party bring a claim (for damages) against directors and officers as a result of  actions or omissions attributable to them.

We have been involved in the majority of the most important directors and officers liability cases in recent years, i.a. the lawsuits following the last financial crisis.

For example:

  • we represented and are still representing a state-owned company in the wake of the last financial crisis in cases against former directors, officers and auditors of the banks that collapsed during the crisis, including six of the biggest and most high-profile and noteworthy legal actions, most of which made it to the Supreme Court (2018-2022)
  • we represented the former directors of a renowned Danish (bankrupt) IT company against claims of directors liability brought by the bankruptcy estate (2015)
  • we represented the board of a cooperative housing association in an action claiming very substantial damages for the allegedly unlawful termination of a residential building purchase (2018).
