Anti-competitive behaviour may cause not only actions and sanctions by the authorities. Those involved may also be liable to pay damages. Cartel activities or abuse of a dominant position have made extensive and complex actions for damages (follow-on damages claims) a legal discipline in its own right in recent years. The amounts claimed in such actions are typically very substantial. 

Our expertise concerns both actions in which we represent the claimant seeking damages and actions in which we defend businesses against such claims, including in class actions.

We have represented, among others:

  • a big Dutch chemicals business in an action brought by a big Danish chemicals business claiming damages for infringement of EU competition rules on cartels (2015)
  • a major manufacturer of trucks in an action brought by a group of claimants claiming damages for infringement of EU competition rules on cartels (2021)
  • a major Danish business met with claims for damages in the amount of DKK 4.5bn (2021).
