State aid and restructuring
We have been involved in various restructurings of enterprises in distress where the public sector has had an interest in the handling thereof, for instance due to critical infrastructure. We assist our clients in ensuring smooth and safe detection and management of State aid risks in this regard.
The State aid rules provide for various possibilities of granting State aid to distressed enterprises. It is a condition for such aid, however, that the public interference/aid does not significantly deteriorate the competitive position held by the competitors of the distressed enterprises.
In addition to assisting in the detection and handling of State aid issues and problems in this regard, we also assist clients in identifying various possible solutions. In order for any restructuring to be successful, it is decisive to avoid the occurrence of unforeseen problems; particularly in relation to distress, the risk of complaints is typically higher. We therefore assist our clients in completing their restructuring projects successfully in an agile and flexible manner ensuring a robust structure and minimising State aid risks.
