We have unparalleled experience of the key rules on nature and area protection, including the habitat and Natura 2000 rules and their implications to land use and concrete business activities.

We provide assistance and advice in matters involving the large number of provisions restricting use and activities due to the need to protect nature and areas – both under the rules of the Danish Nature Protection Act governing protection lines, general prohibitions against changes, and conservation, and under the European Directives on e.g. habitats and bird protection.

Our advice

  • interpretation of the Habitats Directive in the light of the comprehensive and very dynamic practice of the European Court of Justice
  • the validity and lawfulness of permissions and specific regulatory interventions
  • coastal protection projects, climate proofing and other issues relating to the Danish Coastal Protection Act 
  • protected natural habitats, plant and animal species
  • protection lines, including coastal and beach protection lines
  • the scope of conservation orders
  • the right to exemption from a general prohibition or conservation order
  • appeals to the Danish Environment and Food Board of Appeal and/or the valuation authorities.

We are highly experienced in conducting high-profile cases concerning the interpretation of the scope of the Habitats Directive and the complex rules on Natura 2000 protection (international protection areas) in relation to concrete activities, including cases involving reference of questions to the European Court of Justice for a preliminary ruling.
