Markante sager

  • We assist a large Danish utility company in a landmark Supreme Court action concerning the applicability of the "guest pays" principle to the water and waste water fields. We also assist that utility company in the first high-profile legal cases concerning prohibition against use of pesticides in protection zones near borings, and in the associated valuation processes.
  • We represent a Danish municipality in a pending court action against a government agency, among others, concerning the compliance of specific activities with the current local development plan.
  • We represent a Danish municipality in a pending court action against a harbour business tenant in connection with a harbour renewal project.
  • We assist two municipalities with the legalization of the largest windmill park in Denmark whose local plan and permit have been deemed invalid by the Appeal Boards due to compliance issues regarding the Habitats Directive.
  • We assist the Danish Aquaculture Association (acting as agent of a mariculture enterprise) in a high-profile case before the Danish Eastern High Court concerning interpretation of the Habitats Directive in respect of environmental permits for mariculture. The High Court recently decided to refer questions of legal principle regarding the Habitats Directive and an environmental permit for an existing establishment to the European Court of Justice for a preliminary ruling.
  • We assist a large Danish industrial enterprise in a pending court action concerning the liability to pay damages for discharge of contaminated waste water from a waste water treatment plant, and the allocation of such liability between the waste producer, the waste handling entity and the waste treatment facility. 
  • We assist a major extraction company  in an action before the Danish Environment and Food Board of Appeal concerning a regulatory rejection to grant a permit to extract raw materials, including on the basis of registered rights enjoying protection under section 73 of the Constitutional Act of Denmark. The Danish Environment and Food Board of Appeal recently annulled the regulatory rejection as invalid, and the action is now again pending before the regulatory authority. 
  • We have assisted a large oil storage business seeking an environmental permit for its Danish activities
  • We have been involved in the legal battle about the liability for part of the multi-generation contamination from Cheminova.
  • We assist the aggregate maricultural industry and the Danish Aquaculture Association (Dansk Akvakultur) in the actions currently pending as a result of the Danish Ministry of Environment's investigation and compliance activities in relation to Danish mariculture facilities, including their placing permits. Those actions concern complex issues related to compliance, protection of nature, Natura 2000 rules, and the legal framework of mariculture. 
  • We assist the Federation of Retail Grocers in Denmark (De Samvirkende Købmænd) in a pending court action concerning compliance by the shopping centre Fields in Ørestaden, Copenhagen.
